EB-5 Visa Eligibility Requirements

Investment Requirement:

Application Process for the EB-5 Investor Visa

  1. Form I-526 (Petition by Alien Investor): The applicant must file Form I-526 with U.S. Citizenship and Immigration Services (USCIS).
  2. Form DS-260 or Form I-485:
    • If applying from outside the U.S., submit Form DS-260 (Immigrant Visa Application) to a U.S. consulate or embassy.
    • If already in the U.S., submit Form I-485 (Application to Register Permanent Residence or Adjust Status) to obtain conditional permanent residency.
  3. Form I-829 (Petition to Remove Conditions): After two years of conditional permanent residence, submit Form I-829 to remove the conditions and achieve full permanent residency.
