To be eligible for the L-1B visa, the employee must meet several criteria defined by USCIS:

Overseas Company (Foreign Firm):

  • Copy of U.S. office lease (if applicable)
  • Organizational chart of the foreign company
  • Details of the employee’s role in the overseas company and their specialized knowledge

U.S. Company:

  • Latest financial records (tax returns for the past three years)
  • Firm brochure or marketing materials
  • Copy of U.S. office lease
  • Proof of ownership in the overseas company
  • Organizational chart of the U.S. company
  • Visa & I-94 copies (if in the U.S.)
  • Details of the employee’s specialized knowledge and how it will contribute to U.S. operations

Individual Applicant (Overseas Employee):

  • Copy of passport
  • Copy of current U.S. visa (if in the U.S.) and I-94
  • Proof of 1 year of overseas employment with the foreign company (e.g., letter from employer, pay stubs)
  • Resume/CV and education certificates (if applicable)
  • Letters of experience from prior employers (if applicable)
  • Evidence of specialized knowledge through job responsibilities and assignments

L-1B Visa for New Office

For new U.S. offices, the following are required instead of financial documents:

  • Business plan including projections for operations, staffing, and financial forecasts.
  • Organizational chart for the new U.S. office.

Extension or Renewal of L-1B Visa

To extend or renew an L-1B Visa, the following documents are required:

  • Proof of continued employment and role in the U.S. company.
  • Copies of the last three pay stubs from the U.S. employer.
